With reference to our Judiciary, discuss the following:
Name the Writs that the High Courts are empowered to issue. What is meant by the Advisory Jurisdiction of the High Court?
The writs are: Habeas Corpus, Mandamus, Prohibition, Quo Warranto and Certiorari.
The High Courts can offer advice on matters of law / constitution in case the State government or the Governor so desires. The advice given is however not binding on the authority that sought it.
The High Court has appellate jurisdiction over both civil and criminal cases. It can hear an appeal on civil cases tried by the Courts of Munsifs and District Judges. In criminal cases, the jurisdiction extends to cases tried by the Sessions and Additional Sessions Judges. An appeal can be filed against the decision of a Session Judge if the accused has been sentenced to 7 years or more. Capital punishment given by a sessions judge cannot be executed unless it is confirmed by the High Court.
State one point of distinction between the District Judge and the Session Judge.
The District Judge presides over the highest Civil Court in a district and is armed with both Judicial and administrative powers. The District Judge is referred as the session Judge while dealing with criminal cases.
